The candidate would lead the Legal department (about 4-5 team members) with responsibility of the following main activities :
End to end management of necessary legal proceedings towards Public Administration debtors across Spain, as well as private debtors on claiming outstanding amounts and Late payment interest over credits acquired.
This includes among others : drafting administrative claim, legal claim, response to former allegations, appeal to sentence (when applicable), exercise the sentence execution.
End to end management of Commercial contracts with potential assignors (customers), being responsible of internal approval of clauses changes of the standard contract approved
Periodically reporting towards management on status of legal proceeding (public and civil), potential risks found against assignors or debtors, actions on late payment collections, recommendation on appeals against legal proceedings, changes on local law that might affect the business operations.
Support to other departments (Operations, Finance) on budgeting and forecast process, with an estimation of potential Late Interest to be collected
Support to Sales and General Manager in regard to Commercial contracts negotiations or 3rd parties
Responsible of Taxonomy of debtors
Issue legal opinions on various matters that Management could require
Support to Projects and IT system department on development and implementation of new tools / apps to improve Legal proceeding management
Coordinate and manage legal department team
Coordinate and manage relationships with 3rd party legal vendors, among others, potential requests to external lawyers on a specific query related to business Job Requirements :
Solid proven experience on litigations towards Public Administration in Spain
International experience or working on multinational company with reports to international HQ
Prior experience on team management of (at least) 2-3 people
English : C-1 or above. Nice to have :
Background on Financial Sector
Experience on litigations related to claims over outstanding amounts and late payment interests.
